A suspended license is a Class A Misdemeanor! A conviction for a misdemeanor offense, such as this, can further suspend or revoke your license, and could be punishable for up to 364 days in Jail and a maximum fine of $2,500. Obviously, this punishment and fine is a worst case scenario and is not the normal disposition for these matters. However, the more you know about the basis of your suspension, the easier time you will have in Court.

What you may not know about the simple fact that you are charged with a DUI (guilty or not), is the Secretary of State will suspend your license, simply for being arrested. Yes, you heard me correctly. Normally, forty-six (46) days after your arrest, the Secretary of State will enter a Statutory Summary Suspension of your license suspending you for a minimum of six (6) months or up to three (3) years, depending upon your case and your driving history.
However, the timely hiring of an attorney can help you prevent the loss of your license by filing a Petition to Rescind the Statutory Summary Suspension with the Clerk of Court and having a hearing on the merits of your case-not just the word of the Police Officer.
